§ 1 Scope of application

1.1 All deliveries and services provided by Metzger Technik Shop (hereinafter referred to as "Metzger Technik") for the customer are made exclusively on the basis of the following General Terms and Conditions in the version valid at the time of the order. Deviating regulations shall only apply if they have been agreed in writing between Metzger Technik and the customer.

 

1.2 Terms and conditions of the client or third parties shall not apply, even if Metzger Technik does not separately object to their validity in individual cases.

 

 

§ 2 Formation of a contract

2.1 Please note that offers in our Metzger Technik Shop may be limited in time, details can be found in the respective product descriptions.

 

2.2 All offers in the Metzger Technik Shop represent a binding offer to the customer. By ordering the desired goods on the Internet, the customer places a binding order. The prior sale of the goods is reserved. The order confirmation takes place by sending an e-mail.

 

 

§ 3 Prices, Terms of payment

3.1 All prices quoted in our online shop are ex works in Euros (€, EUR) plus packaging and shipping costs and plus the value added tax legally applicable at the time of delivery, in the case of export deliveries customs duties as well as fees and other public charges. The invoices will be delivered to you in paper form when the goods are delivered, unless otherwise agreed with the customer.

 

3.2 The prices stated in the shopping cart or at the checkout apply, these are binding - subject to any price increases due to increased manufacturing or procurement costs - unless there are typing or calculation errors. Metzger Technik will inform the customer after ordering about price increases that have occurred in the meantime. In this case, the list price is valid on the day of receipt of the customer's order. The customer can then confirm his offer at the changed price. Otherwise, Metzger Technik reserves the right not to accept the order.

 

3.3 Payment must be made in the currency Euro (€, EUR).
We reserve the right to generally carry out the delivery against advance payment by bank transfer. Bank charges are completely covered by the customer and will be charged for a fee if deducted.

 

3.4 Der Kunde kann zwischen den folgenden Zahlungsarten wählen:

 

1. Prepayment

In the case of payment in advance, we will send you our bank details by e-mail. Upon receipt of this information, the purchase price must be received without deduction within 14 days on our account. Afterwards we ship the ordered goods.

 

2. PayPal

If you agree on the payment method PayPal, you will be automatically redirected to PayPal's secure payment form after submitting your order. If you already have a PayPal account, just log in. Otherwise, click Set Up Account and follow the instructions. Within seconds we will receive your payment and your goods can be shipped immediately if available.

 

3. Debit, Credit card

In cooperation with PayPal PLUS, we also offer you payment methods by PayPal, direct debit and credit card. This is a PayPal service and you don't need a PayPal account. The debit from your account will take place at the time we accept your order.

 

 

§ 4 Delivery, Shipping costs

4.1 Information on delivery times can be found on the respective product page in our online shop.

In the case of goods that are not in stock, the delivery date usually results from the order confirmation. This information is non-binding, unless otherwise agreed.

In case of delivery delays, we will inform you immediately.

If a part of the order is not immediately available because we ourselves were not supplied on time through no fault of our own, the remaining goods will be delivered without recalculation of the shipping fee.

 

4.2 The vendor is not liable for impossibility of delivery or for delays in delivery, insofar as these are caused by force majeure or other events not foreseeable at the time of conclusion of the contract (e.g. operational disruptions of all kinds, difficulties in the procurement of materials or energy, transport delays, strikes, lawful lockouts, lack of labour, energy or raw materials, difficulties in obtaining the necessary official permits, official measures or the non-existent, incorrect or late delivery by suppliers) have been caused, for which the vendor is not responsible.

 

4.3 Invoicing and delivery takes place within Germany and Europe, other countries on request. Delivery is made by shipment ex warehouse to the delivery address provided by the customer.

 

4.4 Delivery is made against a packaging and shipping fee, the exact amount of which is marked separately for each delivery.

 

4.5 A guaranteed delivery on the following working day is marked in our online shop as "express shipping" and is only possible for deliveries within Germany.

Orders from 12:00 (CET - time zone Germany) will only be processed on the following working day and shipped after receipt of payment.

 

4.5 The minimum order value in our Metzger Technik Shop is 5,00€.

 

 

§ 5 Export control

5.1 If our products are exported to embargoed countries, the customer must investigate the final country of destination of all export orders before dispatch. Metzger Technik GmbH strictly prohibits the deliberate unlawful redirection of deliveries of our products to embargoed countries. In the event of non-compliance, liability shall pass to the customer.

 

5.2 The delivered goods are generally intended to remain and be used in the country of first delivery agreed with the customer. This expressly does not preclude resale by the customer.

 

The sale, resale and disposition of the delivered goods, including any associated technology, may be subject to national and/or international export control regulations or approval requirements, e.g. due to their nature or intended use or final destination. The latter concerns in particular the sale of goods for an intended military or nuclear use and the delivery to embargoed countries or to "listed" persons.

 

By placing the order, the customer declares compliance with such relevant export control regulations in the case of own exports or resales. Furthermore, he declares that he will not deliver the goods directly or indirectly to countries that are subject to an embargo and thus prohibit or restrict the import of the delivered goods. The customer shall indemnify us against all damages resulting for the supplier as a result of the culpable breach of the above obligations.

 

 

§ 6 Reservation of title

6.1 The ordered goods remain the property of Metzger Technik GmbH until full payment has been made. Prior to the transfer of ownership, pledging, assignment by way of security, processing or transformation is not permitted without the express consent of Metzger Technik.

 

6.2 In the event of breach of contract by the customer, in particular in the event of non-payment of the purchase price due, the seller is entitled to withdraw from the contract in accordance with the statutory provisions.

 

 

§ 7 Warranty

7.1 Any warranty claims of the customer expire after 24 months. The limitation period begins with the delivery of the delivery item.

 

7.2 A warranty cannot be assumed for such defects that are due to improper use or above-average stress on the part of the customer as well as not for wearing parts.

 

7.3 In the event of material defects in the delivered items, the Vendor shall initially be obliged and entitled to rectify or replace the goods in accordance with its choice to be made within a reasonable period of time.

The warranty does not apply if the customer changes the delivery item without the consent of the vendor or has it changed by third parties and the removal of defects is thereby impossible or unreasonably difficult. In any case, the client shall bear the additional costs of remedying the defect resulting from the change.

 

7.4 In the case of the purchase of a used item, the customer's claims in the event of defects shall become statute-barred six months from receipt of the goods or description of the article in individual cases with a corresponding marked value reduction, in which the price takes into account the warranty and can therefore exclude it completely. If the customer is a registered trader and the ordered service is provided for his commercial enterprise, his claims in the event of defects shall become statute-barred in accordance with the statutory provisions.

 

 

§ 8 Liability

Metzger Technik shall only be liable for damages other than those caused by injury to life, body and health insofar as these are based on intentional or grossly negligent action or on culpable violation of an essential contractual obligation by Metzger Technik or vicarious agents of Metzger Technik. Any further liability for damages is excluded. The provisions of the Product Liability Act remain unaffected. If an essential contractual obligation is negligently violated, Metzger Technik's liability is limited to the foreseeable damage.

 

According to the current state of the art, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. Metzger Technik is therefore not liable for the constant and uninterrupted availability of the online trading system or for technical and electronic errors during a sales event over which Metzger Technik has no influence, in particular not for the delayed processing or acceptance of offers.

 

 

§ 9 Data privacy

Metzger Technik points out to the customer that the data recorded in the context of the conclusion of the contract will be collected, processed and used by Metzger Technik in accordance with the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG) to fulfil the obligations arising from the purchase contract. This data may also be transmitted to agents and carefully selected partners of Metzger Technik in accordance with § 11 BDSG for the purpose of credit checks.

§ 10 Disposition of the dispute, Other

The exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship is Vaihingen/Enz. The above also applies to third parties who are liable for the obligations of the customer/buyer.

The validity of the UN Convention on Contracts for the International Sale of Goods is excluded, German law applies.
